Phoenix Canopy & Shades LLC designs, manufactures, supplies, and installs a variety of custom shade structures, fabric systems, and related products. This Installation Disclaimer explains the responsibilities associated with professional installations and do-it-yourself (DIY) products.
Professional Installation
When installation services are specifically included in a written proposal or contract, Phoenix Canopy & Shades LLC will perform the work in accordance with the agreed scope of work.
Our installation services are limited to the work expressly identified in the signed agreement. Any additional work requested before, during, or after installation may require a written change order and additional charges.
DIY Products
Products sold for self-installation are intended for customers who possess the necessary skills, tools, knowledge, and experience to safely install construction products.
Phoenix Canopy & Shades LLC does not supervise, inspect, or verify customer installations.
The customer assumes full responsibility for:

Site measurements
-
Structural suitability
-
Engineering requirements
-
Local building code compliance
-
HOA approval, when applicable
-
Utility location and clearance
-
Proper anchoring methods
-
Installation workmanship
-
Safe use of tools and equipment
-
Ongoing inspection and maintenance
Improper installation may result in product failure, property damage, serious injury, or death.
Engineering & Structural Support
Many shade structures require engineering and proper structural support.
Customers are responsible for ensuring that all attachment points, foundations, posts, walls, roofs, footings, and supporting structures are suitable for the loads imposed by the installed product.
Phoenix Canopy & Shades LLC assumes no responsibility for existing structures that are inadequate, deteriorated, improperly constructed, or modified by others.
Permits & HOA Approval
Unless specifically included in a written contract, the customer is responsible for obtaining:

Building permits

Engineering approvals
-
HOA approvals
-
Architectural review approvals
-
Zoning approvals
-
Other governmental approvals required for the project
Approval from a homeowners association does not replace compliance with applicable building codes or safety regulations.
Existing Site Conditions
Phoenix Canopy & Shades LLC is not responsible for concealed or unknown site conditions, including but not limited to:

Underground utilities
-
Irrigation systems
-
Soil conditions
-
Existing structural defects
-
Hidden damage
-
Inaccurate property information provided by others
Additional work required due to unforeseen conditions may result in additional charges.
Maintenance
Shade products require periodic inspection and maintenance.
Customers are responsible for regularly inspecting hardware, anchors, cables, fabric, moving components, fasteners, and structural elements for wear, corrosion, loosening, or damage.
Failure to properly maintain a product may reduce its service life and void applicable warranties.
Weather & Acts of Nature
Shade structures are subject to environmental conditions, including:

High winds

Monsoon storms
-
Heavy rain
-
Hail
-
Snow
-
Lightning
-
Falling debris
-
Extreme temperatures
No shade structure is indestructible.
Customers should follow all manufacturer recommendations regarding weather conditions and remove or secure removable products when appropriate.
Phoenix Canopy & Shades LLC is not responsible for damage caused by severe weather, natural disasters, or events beyond our reasonable control.
Limitation of Liability
To the fullest extent permitted by law, Phoenix Canopy & Shades LLC shall not be liable for damages resulting from:

Improper installation by others

Improper measurements supplied by the customer

Unauthorized modifications

Misuse or abuse of products
-
Failure to obtain required permits or approvals

Lack of maintenance
-
Use of products outside their intended purpose
-
Structural deficiencies of existing buildings or supports
-
Weather-related events beyond normal design conditions
Acceptance
By purchasing products, scheduling installation services, or using products supplied by Phoenix Canopy & Shades LLC, you acknowledge that you have read, understood, and accepted this Installation Disclaimer.
